Digital Collections Copyright Statement

You must ensure your use of any content made available through the digital collections at digital.library.sydney.edu.au (Digital Collections) complies with the Copyright Act 1968 (Cth). This includes, if necessary, obtaining the copyright owner's permission before using such content. It is your responsibility to determine whether the material you want to use requires copyright permission and, if you have obtained permission from the copyright owner, to ensure you comply with their licensing requirements.

Information on copyright provided by the University of Sydney Library does not constitute legal advice. The copyright information in relation to an item made available at digital.library.sydney.edu.au is only an opinion, which may be inaccurate or no longer current. This information should not be relied on for legal decisions. If in doubt, seek legal advice before using the material.

When you are determining whether permission is required, be aware that multiple copyrights can subsist in the same item (eg if a novel includes a copyright-protected photograph, the photograph is protected by a separate copyright to the text, which will potentially require you to obtain more than one permission). If in doubt, it may be best to assume the material is in copyright and that you need to get permission. If permission is required, you will need to find the copyright owner. The University of Sydney Library is not able to assist with locating copyright owners and creators. If you are not able to rely on a copyright exception, the copyright owner has the right to refuse a permission request, to set conditions and to require you to pay a fee for permission.

SETIS material in the Digital Collections

The Sydney Electronic Text and Image Service (SETIS) was developed to provide a scholarly electronic publishing and digital library platform to support and further the programs and goals of the University of Sydney and the University of Sydney Library. SETIS provided access to networked and in-house full text databases, primarily source texts within the humanities.

The Digital Collections contain editions of text and images transcribed by the University of Sydney Library under SETIS. These are the editions with a URL on the first or second page of the electronic file for the editions that includes the following pathway: http://purl.library.usyd.edu.au/setis/ or http://setis.library.usyd.edu.au/ (Editions). If the metadata made available by the University of Sydney Library for an Edition does not say the text and images were reproduced with permission, then the University of Sydney Library believes the text and images in that Edition are in the public domain in Australia but has not made an assessment regarding their copyright status in other countries. If you wish to credit the University of Sydney Library as the source, please use the following statement "From the University of Sydney Library" and provide a link to the Edition in our Digital Collections site.

The University of Sydney Library no longer claims any published edition copyright in Australia in the Editions published before 2000. In relation to Editions published after 1999, the University of Sydney Library still claims published edition copyright in Australia until such time as that copyright expires. Apart from that published edition copyright, the University of Sydney Library does not claim copyright in the other copyright material contained in the Editions other than any University of Sydney shield, logo or coat of arms (University Logo) used in the Editions.

You do not need to obtain specific permission from the University of Sydney Library to use any of its published edition copyright subsisting in an Edition for your own research or study. If you wish to use that published edition copyright for any other purpose, contact the University of Sydney Library for further information.

If you wish to use the text and images contained in an Edition, it is your responsibility to determine whether the material you want to use requires copyright permission. If you need to obtain permission to use the text and images, the University of Sydney Library is not able to assist with locating the copyright owner, creator or person to contact to seek permission. If the Edition contains a University Logo, the University Logo must not be copied or otherwise used by you unless the University Logo is incidentally reproduced when using the unaltered Edition in accordance with this copyright statement

Other material in the Digital Collections

The Digital Collections also contain material that are not Editions created under SETIS (Other Material). The Other Material includes text, images, videos and audio material. Any specific copyright information and terms of use in relation to an item that is Other Material should be set out in the metadata made available by the University of Sydney Library when viewing the item. It is your responsibility to determine whether the material you want to use is in copyright and requires copyright permission. In relation to Other Material that is in copyright, the University of Sydney Library it is not able to assist with locating copyright owners, creators or persons to contact to seek permission.
